公正取引委員会による確約計画の認定について

昨日、公正取引委員会は、独占禁止法に基づく確約手続（以下、「確約手続」）により、当社が提出した確約計画（以下、「確約計画」）について認定し、令和元年6月から開始していた当社に対する独占禁止法違反の疑いに関する調査を終了いたしました。
なお、この公正取引委員会による当社の確約計画の認定は、当社が独占禁止法に違反したことを認定するものではありません。

当社は、認定を受けた確約計画を確実に履行していくとともに、より一層のコンプライアンスの徹底を行い、今後も、高度管理医療機器であるコンタクトレンズを販売する企業として、装用者の眼の健康と安全性の確保に努めてまいります。
なお、確約計画の実行により当社製品の供給に影響が出ることはございません。

（確約手続とは、独占禁止法違反の疑いについて、公正取引委員会と事業者との間の合意により自主的に解決するための独占禁止法第48条の2から9までに規定される手続です。確約計画とは、違反被疑行為を排除するために必要な措置の実施に関する排除措置計画又は違反被疑行為が排除されたことを確保するために必要な措置の実施に関する排除確保措置計画のことを言います。）

Notice Regarding Approval of the Commitment Plan by the Japan Fair Trade Commission

Yesterday, in accordance with the commitment procedures under the AMA (the “Commitment Procedures”), the Japan Fair Trade Commission (the “JFTC”) has approved the commitment plan (the “Commitment Plan”) submitted by CooperVision Japan, Inc. (the “Company”), and has concluded its investigations starting June 2019 against the Company regarding alleged actions under the Antimonopoly Act (the “AMA”). 

Approval of the Commitment Plan by the JFTC does not represent a determination that the Company’s alleged actions constituted violations of the AMA.

The Company, which handles contact lenses as regulatory controlled medical device, will definitely implement the approved Commitment Plan, further enhance compliance, and continue in an effort to secure the health and safety of its consumers’ eyes.  The implementation of the approved Commitment Plan does not affect the supply of any of the Company’s products.

(The Commitment Procedures: procedures that provide for the voluntary resolution of a company’s alleged action under the AMA through mutual consent between the JFTC and the company, as stipulated in Article 48-2 to Article 48-9 of the AMA. Commitment Plan: the Exclusion Measures Plan, which is necessary to eliminate the alleged action; and the Plan for Measures to Ensure Exclusion, which is necessary to ensure that the alleged action has been eliminated.)
